Judge in Barry Bonds Considers Throwing Out Evidence

Barry Bonds doesn't head to court until March 2, but the drama has already started. Bonds is facing 10 counts of making false statements to a grand jury, plus an obstruction of justice charge for allegedly lying to a grand jury about knowingly taking performance enhancing drugs. The prosecution obtained three positive drug tests from 2000-2001 they say belong to Bonds, but the judge Susan Illston wants proof that they actually belong to the baller.

"If there's no testimony to establish that, I don't think any of them work," Illston said according to Associated Press.

According to AP, the only person who can do that is Bonds' personal trainer Greg Anderson who spent time in jail for refusing to speak to a grand jury that was investigating Bonds. Anderson's attorney said that he will maintain his silence and not testify against Bonds.Of course this is a blow to the prosecution's case, but they still have other evidence including recorded conversations where Bonds, Anderson and Bonds' former personal assistant Steve Hoskins discuss injecting steroids and expert doctors who will discuss the changes in Bonds body. Illston has yet to make a final decision on the drug tests but will announce her decision before the case goes to trial.
